General

These Terms and Conditions represents the entire understanding of the requirements, schedule, and payment terms for COMMISSIONED WORK and/or PHOTOGRAPHY JOBS services listed. This agreement contains the entire understanding between the COMPANY and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable.  Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

 

Payment

The Clients agree to retain the COMMISSIONED WORK and PHOTOGRAPHY for the services listed above by reading and agreeing to pay a non-refundable deposit equal to 50%, secures the time and the services of the Artist, and is non-refundable or transferable in the event of a cancellation. The booking fee will be deducted from the cost of the client’s chosen photography services or art services when calculating the final balance due. Payment in full of the remaining balance due will be due one calendar month if it’s a WEDDING or FAMILY SHOOTING, one week before COUPLE SHOOT or PET SHOOT. COMMISSIONED work non-refundable deposit equal to 50% to secure time and services for the painting, and is non-refundable in an event of cancellation. The deposit will be deducted off the cost of the chosen commissioned price, payment in full of the remaining balance due will be due once I the ARTIST have completed the painting.  Weddings that are postponed to a later date will retain the fee, as long as the photographer can re-schedule for the new date and time.

Photography and commissioned services

The details of the chosen service arrangements are to be agreed before hand (in person or email). The client shall contact the ARTIST of any changes in writing (email acceptable). The PHOTOGRAPHER/ ARTIST cannot be held liable for delays or disruption until changes have been acknowledged, in writing.

Cancellation

The client may cancel this contract at any time given written notice, to the ARTIST. But will forfeit any monies paid by CwhiteArt to offset its loss of business. All cancelations must be in writing.

Display

The Client(s) herby allows CwhiteArt (creator) to display any PHOTOGRAPHY, COMMISSIONED work covered by this Terms and Conditions. To promote the business in advertising, websites, social media etc.

Images

All images are nominal. The ARTIST will provide a pleasing colour balance when printing to the images but cannot guarantee exact colour matching. Caused by a combination of dyes and materials especially man-made fibres.

For a WEDDING booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area in which the photographer can cover may not be the photographer’s choice, and the photographer cannot accept reasonability for any obstructed view should this be the case.

Retouching

All PHOTOGRAPHY images will be adjusted for exposure, brightness, contrast, sharpness etc. The PHOTOGRAPHERS judgement regarding these corrections and number of images put forward to the client for preview shall be deemed correct.

Prints/ Reorders

All prints and reorders shall be treated as an extension of this contract, and no reasonability for error will be accepted, unless orders are giving in writing.

Copyright

The copyright Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Artist/s in writing.

Licence

The Artist/s shall be granted artistic licence in relation to the poses photographed and the locations used for PHOTOGRAPHY services. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

The Goods sold by the ARTIST are protected by copyright worldwide and are made available to the ordering party for its personal use only. However, the ordering party shall not reproduce, copy images of this WEBSITE and claim it’s theirs.

RESPONSIBILITIES 

The PHOTOGRAPHER in an event of a WEDDING, COUPLE SHOOTING, FAMILY SHOOTING or PET SHOOTING is not responsible for compromised coverage due to causes beyond the control of the company including but not limited to obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to the PHOTOGRAPHER, rendering of decorations, or restrictions of the locations. The PHOTOGRAPHER is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The PHOTOGRAPHER is not held liable for missed coverage of any part of the event(s).  The ARITST will not be held accountable for failure to deliver images of GOODS or any objects at the event(s).

Attendance

In the unlikely event of the assigned photographer being unable to attend your chosen photography service to unforeseen circumstances. We reserve the right to appoint another photographer to attend your chosen photography service on our behalf to undertake the wedding photography to his/her best ability.

Personal Accidents

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

Governing Law

This agreement shall be governed in accordance with the laws of England and Wales.
